Terms of Service

Effective Date: August 16, 2025

These Terms of Service & Booking Agreement (“Terms”) govern all estimates, quotes, invoices, online bookings, and services provided by Golden Pixxel Media, LLC (“Golden Pixxel Media,” “Company,” “we,” “our,” or “us”).

By requesting a quote, accepting an estimate, booking an appointment, paying an invoice, or using our services, you (“Client,” “you,” or “your”) agree to be bound by these Terms.

1. Services

Golden Pixxel Media provides professional real estate media services, including but not limited to:

  • HDR Photography
  • Aerial Drone Photography & Video
  • Property Videography
  • 2D Floor Plans
  • 3D Floor Plans
  • 3D Video Renderings
  • Virtual Staging
  • Twilight Photography
  • Community Photography
  • Other related digital media services

Specific deliverables, pricing, turnaround times, and included services will be outlined in the booking confirmation, quote, invoice, or written agreement.

2. Booking & Payment

Golden Pixxel Media may provide quotes or estimates through its online booking system or other communication channels.

Acceptance of a quote, confirmation of a booking, payment of an invoice or deposit, or use of our services constitutes acceptance of these Terms.

A deposit may be required to reserve an appointment.

Unless otherwise agreed in writing, payment is due upon delivery of final files.

Golden Pixxel Media reserves the right to withhold final deliverables until payment has been received in full.

Late payments may be subject to additional fees.

Returned payments, unpaid balances, or unauthorized chargebacks may result in suspension of future services and collection efforts.

3. Cancellation & Rescheduling

Golden Pixxel Media understands that schedules can change and strives to provide reasonable flexibility while reserving time and resources for each appointment.

Standard Cancellation & Rescheduling

Appointments may be cancelled or rescheduled without charge up to two (2) hours before the scheduled appointment time.

Appointments cancelled or rescheduled within two (2) hours of the scheduled appointment may incur a $95 cancellation fee.

Weather-Related Cancellations & Rescheduling

Photography and drone services are dependent on weather conditions.

If weather conditions make photography or drone operations unsafe or unsuitable, Golden Pixxel Media may reschedule the appointment at no additional charge.

Weather-related rescheduling may occur before or after the scheduled appointment time if conditions unexpectedly deteriorate or fail to improve.

Decisions regarding weather-related rescheduling will be made by Golden Pixxel Media in consultation with the Client whenever reasonably possible.

If the Client chooses to cancel rather than reschedule when services can reasonably proceed, the standard cancellation policy will apply.

No-Shows & Access Issues

If the property is inaccessible due to:

  • Lockouts
  • Missing access instructions
  • Unavailable occupants
  • HOA restrictions
  • Client delays
  • Other circumstances preventing completion of the appointment

the appointment may be treated as a late cancellation and the $95 cancellation fee may apply.

All cancellations, rescheduling requests, and access issues should be communicated by phone to Golden Pixxel Media or the assigned photographer whenever possible.

4. Refunds

Due to the custom nature of professional photography, videography, and digital media services, refunds are handled on a case-by-case basis.

If the Client cancels an appointment within the permitted cancellation timeframe and no services have been performed, any eligible refund will be issued less any applicable fees outlined in these Terms.

Once photography, videography, scanning, editing, production, or other services have been performed, payments are generally non-refundable.

If the Client has concerns regarding delivered media, Golden Pixxel Media will work with the Client in good faith to address reasonable correction requests or revisions as outlined in these Terms.

If Golden Pixxel Media is unable to complete a scheduled service due to circumstances within our control, the Client may choose to reschedule or receive a refund for services that were not performed.

Refunds do not apply to:

  • Weather-related scheduling changes
  • Client preference differences
  • Property preparation issues
  • Minor variations in image appearance
  • Delays outside our reasonable control
  • Services already completed

5. Client Responsibilities

The Client is responsible for:

  • Obtaining permission for property access
  • Ensuring the property is available at the scheduled time
  • Preparing the property before the appointment
  • Securing pets
  • Removing confidential, personal, or sensitive items

Golden Pixxel Media is not responsible for:

  • Cleaning
  • Decluttering
  • Staging
  • Moving furniture
  • Removing personal belongings
  • Preparing the property for photography

If the property is not ready at the scheduled appointment time, services may proceed as-is.

6. Order Accuracy

The Client is responsible for providing accurate information regarding:

  • Property address
  • Square footage
  • Property type
  • Requested services
  • Access instructions

If inaccurate information results in additional work, production requirements, or pricing adjustments, Golden Pixxel Media reserves the right to modify the invoice accordingly.

Commercial properties, multi-unit properties, and specialty projects may require customized pricing.

7. Drone Services

Drone photography and video services are subject to:

  • FAA regulations
  • Airspace restrictions
  • Temporary Flight Restrictions (TFRs)
  • Weather conditions
  • Safety considerations
  • Operational limitations

Golden Pixxel Media reserves the right to modify, postpone, substitute, or cancel drone operations when flights cannot be conducted safely or legally.

The inability to legally operate a drone does not constitute a breach of these Terms.

8. Delivery

Golden Pixxel Media generally delivers completed media within approximately two (2) business days.

Projects involving:

  • Video editing
  • 3D renderings
  • Virtual staging
  • Large properties
  • Additional production work

may require additional processing time.

Delivery timelines are estimates only and are not guaranteed.

Golden Pixxel Media is not responsible for delays caused by weather, equipment failure, software issues, internet outages, third-party providers, or circumstances beyond our reasonable control.

9. Accuracy of Media

Golden Pixxel Media strives to provide accurate and high-quality media.

However:

  • Colors may vary due to lighting conditions, editing, and display settings.
  • Floor plans are marketing tools and are not architectural drawings, surveys, or legal documents.
  • Measurements may differ from tax records, builder plans, or official property measurements.

10. Copyright & Ownership

Golden Pixxel Media retains all copyrights and ownership rights to all media produced, including:

  • Photographs
  • Videos
  • Drone imagery
  • Floor plans
  • Renderings
  • Virtual staging
  • Scans
  • Editing files

RAW files, original video footage, project files, and editing assets remain the exclusive property of Golden Pixxel Media and are not included with purchased services.

Golden Pixxel Media is not required to retain RAW files after project completion.

11. License to Use Delivered Media

Upon full payment, the Client receives a perpetual, non-exclusive, non-transferable license to use delivered media for:

  • MLS listings
  • Real estate marketing
  • Digital advertising
  • Print advertising
  • Social media
  • Listing presentations
  • The Client’s real estate website

This license is granted only to the purchasing Client.

Media may not be:

  • Sold
  • Transferred
  • Licensed to another party
  • Provided to another agent
  • Used by builders, designers, contractors, developers, or third parties

without written permission from Golden Pixxel Media.

Separate licensing may apply for:

  • Airbnb or vacation rental marketing
  • Builder marketing
  • Commercial advertising
  • Publications
  • Other commercial uses

12. Portfolio & Promotional Use

Unless confidentiality is requested in writing before the scheduled appointment, Golden Pixxel Media reserves the right to use completed media for:

  • Website portfolio
  • Social media
  • Advertising
  • Marketing materials
  • Industry competitions
  • Educational purposes

13. Revisions

Two (2) complimentary revisions are included for 2D and 3D floor plans.

Additional revisions, redesigns, or significant modifications may incur additional fees.

14. File Storage

Delivered media will remain available through Golden Pixxel Media’s delivery platform for one (1) year from the date of the shoot.

After one year, files may be permanently removed without notice.

Archived copies, if available, may be retrieved at Golden Pixxel Media’s discretion and may be subject to a retrieval fee.

Golden Pixxel Media does not guarantee long-term storage or availability of files after the one-year storage period.

15. Additional Charges

Additional charges may apply for:

  • Valet parking
  • Travel outside the standard service area
  • Additional editing requests
  • Rush delivery
  • Oversized floor plans
  • Additional production requirements

Applicable fees will be communicated whenever reasonably possible.

16. Limitation of Liability

To the fullest extent permitted by law, Golden Pixxel Media shall not be liable for indirect, incidental, consequential, special, or punitive damages.

Golden Pixxel Media’s total liability shall not exceed the amount paid by the Client for the specific service giving rise to the claim.

17. Indemnification

The Client agrees to indemnify, defend, and hold harmless Golden Pixxel Media, LLC, its owners, employees, photographers, videographers, independent contractors, and affiliates from claims arising from:

  • Property access
  • Unauthorized use of media
  • Incorrect information provided by the Client
  • Third-party claims related to the services provided

18. Independent Contractors

Golden Pixxel Media may use qualified employees or independent contractors to perform services on its behalf.

19. Force Majeure

Golden Pixxel Media is not responsible for delays or inability to perform services caused by circumstances beyond reasonable control, including:

  • Hurricanes
  • Severe weather
  • Flooding
  • Government restrictions
  • Internet outages
  • Equipment failures
  • Acts of God

20. Governing Law

These Terms are governed by the laws of the State of Florida.

Any disputes shall be resolved in courts located in Miami-Dade County, Florida.

21. Updates to These Terms

Golden Pixxel Media reserves the right to update these Terms at any time.

The most current version will be available on our website.

Continued use of our services after updates constitutes acceptance of the revised Terms.
